MEMORANDUM OPINION GRANTING MOTION TO DISMISS DUÉ TO LACK OF SUBJECT-MATTER JURISDICTION

Presently before the Court is a motion to dismiss [9] filed by Defendant, United States of America (the “Government”), *622pursuant to Rules 12(b)(1) and 12(b)(6) of the Federal Rules of Civil Procedure. Upon due consideration, the Court finds the motion should be granted on Rule 12(b)(1) grounds, because the Court lacks subject-matter jurisdiction over the case.
