On April 7, 1978, the appellant Long filed a complaint alleging that Van’s Enterprises, while engaged in the execution of a public contract to lay pipe for the city of Midway, damaged him (Long) by causing flooding upon his property and causing loss of business by leaving an open trench blocking access to his business premises for an excessive period (lasting for 18 months).
