This was a suit for partition by the appellants against the appellee. It was tried by the court at *396special term, and, at request of the parties, the facts were found specially, and conclusions of law were stated thereon, first, that the plaintiffs are entitled to two-thirds of the land in controversy; second, that the defendant is entitled to one-third of said land. The plaintiffs excepted to the conclusions of law. There were other conclusions of law, but as they depend upon those above stated they need not be specially considered.
