The plaintiff company is the publisher of a newspaper in the county of Lycoming, and the defendant was in 1902 the clerk of the court of quarter sessions of said county. The defendant caused the list of applicants for license to sell liquors, for the *245year in question, to be published in three newspapers of the county, designated by him, in accordance with the provisions of the third section of the Act of July 30, 1897, P.
