The litigation that has occasioned this appeal is an action for damages for claimed false arrest brought by plaintiff against O. F. Keeling, sheriff of Polk county, Iowa, and two of his deputies, Fred Berg and L. E. Forbes. At the time of his arrest plaintiff was residing in Omaha, Nebraska, where he was employed as a truck driver. Plaintiff was taken into custody by the Omaha authorities on or about May 16, 1936 by reason of a telegram sent from the Polk county sheriff’s office and over the signature of C. F.
