Carr, J.,
— This action in assumpsit was brought by a wife against her husband to recover the amount of his promissory note to her order made and delivered under the terms of a post-nuptial agreement, and also to recover the proceeds in his hands of a sale of land belonging to her. His defense to the note was that a breach of the agreement on her part estopped her from asserting the right to payment.
