Frost, as assignor to the Union Manufacturing Company, a name by which the complainant was formerly known, it having been since changed by amendment of its articles of incorporation.

It appears from the opinion of the learned judge who heard this case at the circuit, that some stress was there laid upon a decree sup*339posed to hare been rendered in a former suit relating to their respective patents between these companies while they were doing business under other names, as mentioned in the preceding statement, wherein the Frost patents, Nos. 428,072 and 431,045, were declared to be invasions of rights secured by the Marsh patent, No. 394,656.
