The complaint avers that at an election held in and for the city of Albany on the second Tuesday of April, 1882, “ the above named John Swinburne was, as the plaintiffs allege upon information and belief, by the greatest number of legal votes cast at such election, duly and legally elected mayor of said city of Albany for the term of two years, to commence on the first Tuesday of May, 1882, and this action is brought upon the relation of the said John Swinburne.
