The facts upon which the legal question presented on tins record is raised are quite novel. It appears from the evidence that Andrew Moore is the owner of a row of buildings between the hotel known as the Girard House, and Ninth street, extending *80from Jayne street to Chestnut. The most northerly of these buildings is No. 29 South Ninth street, and it has been occupied for some time by the plaintiffs as lessees of Moore. The building next to No. 29 is in the occupancy of Geo. M. Moore as a tenant, and is but one story high. The other buildings down to Chestnut…
