ORDER AND MEMORANDUM DECISION
On October 14, 1984, the United States filed this civil action seeking recovery for damages it sustained in connection with certain bank loans guaranteed by the Small Business Administration (“SBA”) and the Farmers Home Administration (“FmHA”), two federal agencies authorized by Congress to guarantee loans made to businesses. The amended complaint (doc. 50) contains seven counts. Counts I through III arise under the False Claims Act, Title 31, United States Code, §§ 3729-31.
