This case is before us on a Government interlocutory appeal, pursuant to Article 62, *572Uniform Code of Military Justice, 10 U.S.C. § 862, and Rule for Courts-Martial 908, Manual for Courts-Martial, United States (2005 ed.). The Government contends that the military judge erred as a matter of law when she issued an order dismissing with prejudice the charges and specifications against the appellee on the grounds that the Government violated the appellee’s right to a speedy trial under R.C.M. 707 and Article 10, UCMJ, 10 U.S.C. § 810.
