MEMORANDUM OPINION AND ORDER
ANNA DIGGS TAYLOR, District Judge.
Plaintiff RPM Pizza, Inc. (“RPM”), claims in this lawsuit against Bank One-Cambridge (the “Bank”) that the Bank’s payment of a check drawn on RPM’s account was negligent and violated the requirements of the Uniform Commercial Code, as adopted in Ohio. 1 Specifically, in count II of the complaint, RPM alleges that the Bank acted negligently, breached its duty to RPM, and breached provisions of the Uniform Commercial Code.
