| ¶ Petitioner Joseph M. Bienemy was found guilty by a jury of being an accomplice to capital murder in the death of Carlos Deadmon, who was shot twenty-two times as he sat in his vehicle attempting to leave the Pecan Street Apartments in Se-arcy, Arkansas. Bienemy was sentenced to life imprisonment without parole. On appeal Bienemy argued that the evidence presented at trial was insufficient to support his conviction.
