Appellant James A. Michaels was found guilty by a jury of operating an automobile while intoxicated, a misdemeanor, and was fined $500. We affirm.
We first note that a representative of the Prosecuting Attorney for St. Louis County did not file a brief or appear before this court at oral argument of this case. We recognize that under the present Supreme Court Rules there is no penalty for such failure, Shephard v.
