This is a petition for declaratory judgment brought against Hugh Gallen, as Governor, by certain members of the General Court in their capacity as president of the senate, speaker of the house, chairman and vice-chairman of the legislative fiscal committee and as individual taxpayers. The plaintiffs seek a judicial declaration that the creation of twelve new positions within the Governor’s office, proposed in connection with a federally funded comprehensive children and youth project, is unlawful absent prior legislative fiscal committee review and approval.
