This action was instituted in the district court of Payne county by the Spurrier Lumber Company, et al., as plaintiffs, against Robert M. Carpenter and Albert L. Treese, as defendants, to recover for labor and other material furnished to Robert M. Carpenter, a contractor, in constructing a building' for the owner, Albert L. Treese. Personal judgment was sought against the contractor and a lien was sought on the property of the owner, Treese. '
