Appellant, Fred H. Mudgett (hereinafter referred to as plaintiff) has appealed from the judgment of the trial court denying his petition for release from Fulton State Hospital. We have appellate jurisdiction because the case involves issues which, if decided, would require a construction of certain constitutional provisions. Art. V, § 3, Mo.Const., V.A.M.S. We deem it advisa*473ble to state at the outset, however, that we will not decide this appeal on the merits because the case has been rendered moot by developments occurring since the appeal was taken.
