Appeal by the defendant, Eosa W. Strans, individually and as executrix, etc., from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 2d day of October, 1909, upon the report of a referee. Judgment affirmed, with costs, on opinion of referee.

This suit was brought by the plaintiff as a creditor of Louis Straus, deceased, in behalf of itself and all other creditors, for the purpose, among others, of having it adjudged that that portion of the aggregate amount of life insurance policies upon the life of said Louis Straus purchased by the excess of premiums above $500, annually, out of his property, be brought into court and administered according to law for the benefit of said creditors.
