Dr. Pedro Ramos instituted this action against Boehringer Manheim Corporation1 seeking damages resulting from the defendant’s alleged infringement of claims one, *1067three and five of United States Patent No. 4,380,090 (“090 patent”), a patent issued to Dr. Ramos and owned by him throughout the pendency of this action.
