This is an action instituted by Dale V. Horn, as Plaintiff-in-error, hereinafter called Horn, against Commercial Carriers, Inc., hereinafter called Commercial, and its employee, Jim Matt Mooneghan, hereinafter called Mooneghan, and Fraker Heating and Equipment Co., Inc., hereinafter called Fraker, and its employee, Richard Nix, hereinafter called Nix, in the Circuit Court for Knox County, ■ Tennessee, for damages.
