In April of 1952, a petition for the annexation of territory to the Village of Muttontown was filed, pursuant to section 348 of the Village Law, for submission to the town board of the Town of Oyster Bay for its consent. The petition was signed by the owners of a majority in value of the property sought to be annexed. The town board refused its consent to the petition for annexation setting forth several “ reasons ”, one of them being that “ it does not appear that the persons signing the petition constitute a majority of the persons residing within such territory qualified to vote for Town…
