This suit was instituted in the District Court of Palo Pinto County on the 12th day of December, 1900, by the appellant, G. W. Warren, Sr., against appellee Foust and the justice of the peace of precinct Fo. 3, Tarrant County, and the constable of precinct Fo. 5, Palo Pinto County, to restrain them from further proceeding in the collection and execution of a certain judgment rendered in said Justice Court of Precinct Fo. 3, on the 19th day of December, 1890, in favor of appellee Foust and against appellant G.
