This was an action brought by Hood and Lumley, defendants in error, against the plaintiff in error in the district court of Lincoln county, to recover the value of a certain stock of goods and merchandise alleged to have been wrongfully attached by the defendants in error and converted to their own use. The plaintiffs in error alleged in their answer that the goods were wrongfully taken under the writ of attachment, that the stock of goods was the property of Morrison, that Morrison was insolvent and in failing circumstances; and that Hood and Lumley, with…
