OPINION OF THE COURT

The State Commission on Judicial Conduct has determined that petitioner, a Justice of the Supreme Court, should be removed for misconduct. The primary question is whether this sanction is appropriate for petitioner who is suffering from alcoholism and cancer and, as a result of his ill health, had submitted his resignation and applied for retirement prior to the commission’s recommended determination of removal.
