This is an action for damages for malicious prosecution. Upon issues being joined, the cause was tried to a jury and resulted in a verdict in plaintiff’s favor for the sum of $5,000 against the defendant Metropolitan Life Insurance Company, .upon which judgment was duly entered for the amount thereof. The defendant Metropolitan Life Insurance Com-, pany has prosecuted appeal to this court from the judgment.
