COLEMAN, Circuit Judge:
The United States Postal Service appeals the granting of appellee Lawyer A. Adkins’ motion for summary judgment in which the Court set aside the discharge of Mr. Adkins and ordered his reinstatement with back pay and all other benefits from November 30, 1972. The Postal Service asserts three arguments for reversal of this decision: (1) the District Court erroneously concluded that the Postal Service violated its own regulation in discharging Adkins; (2) the Postal Service was never joined as a party to this action and the Court was without jurisdiction to grant the…
