KELLEY, Justice.
The owners of a supper club which had been destroyed by fire brought this action against respondent insurance agents who had sold them a fire insurance policy written by a surplus lines insurer. The owners claim the liability of the agents arises from the Minnesota agents liability law which imposes personal liability on a person who participates in the sale of insurance on behalf of any insurance company which is required to be, but is not, authorized to engage in the business of writing insurance in this state.
