The plaintiff, acting under authority vested in him as the surviving trustee under a will, entered into a contract with the defendant, Conrad Pfeifle, by which the plaintiff agreed to sell to the defendant a quarter section of land in Cascade county for $4,000. The contract provided for a small cash payment on the execution of the contract and for subsequent annual payments running over a period of years.
