McCALEB, Justice.

This is a suit for workmen’s compensation arising out of an accident occurring on April 19, 1954, in which plaintiff suffered serious personal injuries in the performance of his duties as a caterpillar tractor operator for his brother, Joseph Kline, who was engaged in the logging business. It is undisputed that his employment was hazardous and that his brother, as his immediate employer, would be liable to him for compensation.
