MEMORANDUM
EDGAR, District Judge.
This matter is presently before the Court on plaintiff’s motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. This action is brought by plaintiff under the Labor-Management Reporting and Disclosure Act of 1959, 29 U.S.C. § 401 et seq. (hereinafter referred to as the “Act” or “LMRDA”), and jurisdiction is conferred upon the Court by 29 U.S.C. § 482(b). Plaintiff, upon the complaint of Union member Parnell F.
