SPELLMAN, District Judge.

THIS CAUSE comes before the Court upon the Defendant’s and the Plaintiff’s respective Motions for Summary Judgment. Both parties have stipulated that no issues of fact remain to be litigated. See Joint Pretrial Stipulation at 5.
