BUFFINGTON, District Judge.
This is a motion for a new trial. On October 11, 1904, the plaintiff, Frank E. Bainum, a minor and citizen of Pennsylvania by his next friend, brought suit in this court for the recovery of damages for personal injuries against the American Bridge Company, averring it was a corporation of the state of New Jersey.
