SEVERENS, Circuit Judge.

On the 6th day of April, 1906, Hernán, the plaintiff in error, brought suit in the court below against the American Bridge Company by filing his petition, taking out a summons, and delivering the latter to the marshal for service. The summons did not describe the citizenship of the American Bridge Company, but in his petition the plaintiff described it as “a corporation organized under the laws of New York.” The complaint of the petition was of a personal injury sustained by him on September 8, 1905, while in the employment of the American Bridge Company, in its shop…
