Affirming.
At a late hour of an evening in March or April, 1934, Comer Franklin, a youth seventeen years of age, was murdered in Mercer county, Ky. The place was on a. side road a short distance from the state highway and not far from Herrington Lake formed by the damming of Dix river. The guilty party or parties tied a rock to his body with a wire and threw it into the lake.
