J., dissenting, arguendo. This is an indictment against the defendant for the violation of the provisions of chapter 216, Laws 1907, ratified 2 March, 1907, commonly known as the "Passenger Rate Law." The act does away with the requirement that all railroad companies shall furnish first- and second-class passenger accommodations, and establishes a uniform (498) rate of 2 1/4 cents per mile for passenger travel.
