MORROW, Presiding Judge.
— Cattle theft is the offense; punishment fixed at confinement in the penitentiary for a period of two years.
The State’s evidence is direct to the effect that four cows under the control of W. J. Rhodes and belonging to his wife, were driven by the appellant and Arthur Carpenter to a barn on the pasture of the appellant’s father, upon which pasture the appellant also lived; that one of the cows was taken into the bam and butchered and sold to the witness Hillyer; that before butchering the cow the appellant arranged with Hillyer to sell him the carcass.
