Mrs. J. C. Plunkett sued the railroad company for the homicide of her husband, and recovered a verdict. The defendant excepts to the overruling of a motion for a new trial, containing only the general grounds. The deceased was a passenger from Macon to Mayfield on the defendant’s railroad, and when his destination was reached he was so intoxicated that it was necessary for him to be bodily removed from the train. He was placed on some grass about 35 feet from the track, on the right of way, on the same side of the track as the station, near a path leading from the station to the public…
