Suit was brought against the Southern Railway Company for the death of Charlie Humphries, alleged to have been caused by one of the defendant’s trains. A general demurrer to the petition was sustained, and the plaintiff excepted. The petition alleges: "(3) that on or about the 9th day of December, 1932, Charlie Humphries was struck down and killed by a passenger-train then and there under the control of the Southern Railway Company. . .
