Appeal from a judgment of the County Court of Schenectady County (Eidens, J.), rendered January 22, 2001, convicting defendant upon his plea of guilty of the crime of criminal sale of a controlled substance in the third degree.

Defendant was indicted on two counts of criminal sale of a controlled substance in the third degree, three counts of criminal possession of a controlled substance in the third degree and three counts of criminal possession of a controlled substance in the seventh degree. These charges arose out of his sale of cocaine to a confidential police informant on two occasions…
