This is an action brought by the Village of East Rochester as plaintiff for a declaratory judgment to determine its right to use the streets of the village to construct a municipal fighting plant for the purpose of lighting the streets and to sell electricity to private consumers, as against a claim by the Rochester Gas & Electric Corporation that the latter had acquired an exclusive right for such use of the streets prior to the incorporation of the village.
