OPINION

DALLY, Judge.

This is an appeal from a conviction for the misdemeanor offense of possession of less than two ounces of marihuana. The punishment is a fine of $150.00.

*873Appellant first contends that the marihuana was discovered pursuant to an unlawful search and seizure. Appellant also contends there was insufficient evidence to establish that he had possession of the marihuana.
