HARTIGAN, Circuit Judge.

This is an appeal from a judgment of the United States District Court for the District of Massachusetts dismissing the plaintiff’s complaint following special verdicts of the jury.

The plaintiff’s amended complaint was in three counts. The first count was brought under the Jones Act, 46 U.S.C. A. § 688, and sought recovery for injuries allegedly suffered on or about May 28, 1955 because of the negligence of the defendant who was captain and part owner of the fishing vessel Annie M.
