The Chicago, Rock Island & Gulf Railway Company has appealed from a judgment against it for damages in the sum of $4,500 in favor of E. H. Shockley and wife for the death of their son Myrle Shockley, which was alleged to have been due to the defendant’s negligence.
A “jitney” motor car, in which 11 persons, including plaintiffs’ son, Myrle Shockley, was struck by one of defendant’s trains' at the place where the railway track crossed Belknap street, one of the public streets of the city, and as a result of the collision Myrle Shockley and other passengers in the jitney were killed.
