This matter is pending for consideration of Defendant University of Kentucky’s motion to dismiss Plaintiff Kentucky Mist Moonshine, Inc.’s (hereafter, “KM”) Amended Complaint [Record No. 8] and the plaintiffs motion for leave to file a Second Amended Complaint [Record.No. 22].
