MEMORANDUM AND ORDER
FRANK A. KAUFMAN, District Judge.
On August 7, 1973, the defendant, the driver of a truck who was in the course of delivering produce, including potatoes, limes and the like, to the commissary at Andrews Air Force Base, was observed to take from containers of such produce after certain items of that produce were unloaded from the truck and to place in a bag bearing the name upon it of the commissary some of those certain items, and then to secrete such bag on the truck.
