— This matter comes before the court on plaintiff’s complaint in mandamus against the Mayor, the Director of Public Safety and the Civil Service Commissioners of the City of Philadelphia praying that this court enter an order that plaintiff is entitled to the office of patrolman in the Bureau of Police, Department of Public Safety, of the City of Philadelphia, and that an order of August 9, 1950, is*208sued by the director of public safety, retiring plaintiff from service, be declared null and void.
