Before the Court is the Motion for Summary Judgment of Defendants John Kray-nik and Philip Habeeb (Doc. 62). For the reasons discussed below, the motion is DENIED.

I. BACKGROUND

This case arises from the tragic shooting death of 15-year-old Brandon McCloud in the City of Cleveland, Ohio during the early morning hours of September 1, 2005.
