This suit ivas filed to recover damages for the alleged negligent killing of Oscar Scott by the appellant and defendant below, Louisville & Nashville Railroad Company, on December 5, 1916. The accident resulting in decedent’s death occurred at a grade crossing in the town of Campbellsburg, Henry county, at about 9:33 a. m., by a fast passenger train going east from Louisville to Cincinnati colliding with an automobile truck in which the deceased was riding.
