This was a suit in equity by John G-. Lettelier against William Mann and George E. .Johnson, co-partners, etc., for alleged infringement of letters patent No. 482,484, issued September 13,1892, to complainant, for an improvement in machines for forming channel strips, etc. The cause was beard on demurrer to the bill.

WELLBORN, District Judge.

This is a bill in equity, to enjoin the defendants from using a certain patent, and to recover damages for past infringements. The bill alleges:

“That your orator is the original and first discoverer and inventor of a new and useful improvement in machines for forming channel strips for use in the manufacture of open-topped fruit baskets and boxes. That he filed his application for a patent on said discovery and invention in the United States patent office on the 28th day of March, 1891.
