The defendant, Joseph Skender, appeals from a decree of the superior court of Cook County which ordered him to perform his contract to sell real estate to the plaintiff, Jules Gravelot. A freehold is involved.

The contract was executed on April 23, 1946. Defendant agreed to- sell, and plaintiff agreed to buy for $44,000, a three-story brick building containing 11 stores and 40 apartments located at the intersection of Archer Avenue and 33rd Street, in Chicago.
